Martin Kpebu Prepares Petition for Removal of Special Prosecutor Kissi Agyebeng

Private lawyer Martin Kpbeu has announced that he is getting ready to file a formal petition. This petition will ask for the removal of the Special Prosecutor (OSP), Kissi Agyebeng. According to him, there are sufficient grounds to trigger the constitutional removal process, including allegations of incompetence and corruption.

“I am also petitioning for the removal of Kissi Agyebeng… on the grounds of corruption and incompetence,” Kpbeu stated during an appearance on The Key Points on TV3 on Saturday, December 1.

His announcement comes amid reports that the President has submitted 10 petitions to the Chief Justice for a prima facie determination on the conduct of both the Special Prosecutor and the Chairperson of the Electoral Commission (EC), Jean Mensa.

According to the state-owned Daily Graphic on Monday, December 1, seven petitions seek the removal of Jean Mensa and her two deputies—Dr. Bossman Eric Asare, responsible for Corporate Services, and Samuel Tettey, in charge of Operations. Three additional petitions focus on the removal of Special Prosecutor Kissi Agyebeng.

Checks by Graphic Online’s Emmanuel Ebo Hawkson indicate that all petitions have been forwarded to the Chief Justice, Justice Paul Baffoe-Bonnie, who is mandated to assess whether a prima facie case has been established.

Under Article 70(2) of the 1992 Constitution, the President appoints the EC Chairperson, Deputy Chairpersons, and other members based on the advice of the Council of State. Their conditions of service—and consequently, their removal procedures—mirror those of Justices of the superior courts.

The EC Chairperson enjoys terms equivalent to a Justice of the Court of Appeal, while the two deputies are aligned with the conditions of service of Justices of the High Court. This means any removal must undergo strict constitutional scrutiny and due process.
