EC Chair and Special Prosecutor Remain in Office After Mahama Rejects Petitions
President John Dramani Mahama has formally dismissed petitions seeking the removal of the Chairperson of the Electoral Commission, her Deputies, and the Special Prosecutor after the Chief Justice determined that no prima facie case had been established.
The decision follows the submission of seven petitions calling for the removal of the Electoral Commission Chairperson and her Deputies, as well as three separate petitions seeking the removal of the Special Prosecutor.
In accordance with Article 146 of Ghana’s 1992 Constitution and Section 15 of the Office of the Special Prosecutor Act, 2017 (Act 959), President Mahama referred the petitions to the Chief Justice, Justice Paul Baffoe-Bonnie, for a determination on whether they disclosed a prima facie case.
By a letter dated January 26, 2026, the Chief Justice informed the President that the petitions did not establish any prima facie case to warrant further investigations or proceedings for removal.
The determination effectively brings the matter to a close, as the constitutional process requires the establishment of a prima facie case before any formal removal proceedings can begin.
The presidency, in a statement signed by Felix Kwakye Ofosu, Spokesperson to the President and Minister for Government Communications, confirmed that no further action will be taken regarding the petitions.
Under Ghana’s constitutional framework, the removal of key officeholders such as the Electoral Commission Chairperson and the Special Prosecutor requires strict adherence to laid-down legal procedures. The President’s role includes referring such petitions to the Chief Justice for an initial assessment.
With the Chief Justice’s finding that no prima facie case exists, the officials named in the petitions remain in office.
